PRX Pubcatcher Terms of Use
Preamble
The Public Radio Exchange (PRX) offers PRX member stations Pubcatcher as a podcast receiving tool for listeners and a podcast directory management service for stations.
Pubcatcher is a streamlined podcast "receiver" geared towards public radio listeners and distributed by stations. Each Public Radio Exchange (PRX) member station has the opportunity to distribute a customized version to its listeners - "WXYZ Pubcatcher" - that comes pre-filled with the station's podcast feed, feeds it has chosen as favorites, and a complete directory of other public radio feeds from around the system.
In order for us to offer this application and support the services responsibly and effectively there are legal requirements we require you to abide by in order to participate. By using Pubcatcher, a service of the Public Radio Exchange ("PRX", a project administered by the Station Resource Group, Inc) you are agreeing to be bound by the following terms and conditions ("Terms of Use").
We may modify these Terms of Use from time to time. A link to the current Policies is in the Help/Site Policies section of the PRX.org and Pubcatcher.org Site.
1. TERM. The Term is concurrent with the station's paid annual membership with PRX.
2. LICENSE. Pubcatcher is available under the terms of the GNU General Public License as published by the Free Software Foundation; either version 2 of the license, or (at your option) any later version. By using and distributing Pubcatcher you agree to abide by the terms of the GNU General Public License during and after the Term. You can redistribute this software and/or modify it under those terms. Pubcatcher is distributed in the hope that it will be useful, but without any warranty of merchantability or fitness for a particular purpose. 3. PRX SUPPORT. During the Term PRX provides support to station staff for managing, updating, and offering Pubcatcher to the public. PRX does not offer direct end-user support other than a general online help guide and FAQ.
4. DISCLAIMER OF WARRANTY ON SOFTWARE. You expressly acknowledge and agree that use of The Software is at your sole risk. The Software is provided 'AS IS' and without warranty of any kind. PRX and PRX's licensor(s) expressly disclaim all warranties and/or conditions, express or implied.
5. LIMITATION OF LIABILITY. Under no circumstances, including negligence, shall PRX be liable for any incidental, special, indirect or consequential damages arising out of or relating to this license.
